Installation and Payments

Our prices do not include installation charges but an estimation can be provided. It is the responsibility of the customer to confirm all labour charges with the installer before works are carried out. The price for the installation is to be paid directly to the fitter, this is entirely separate to the purchase of the goods. The customer shall ensure that adequate protection of all fixtures and fittings on site is provided prior to delivery and installation. The Company accepts no liability whatsoever for any damages where such adequate protection is not in place. All suggested trades including installers are independent of the company and self-employed, they are not employees of Robert Phillips Fireplaces.

We accept no responsibility or liability for any damages or injuries sustained, whether to property or persons, during the installation or un-installation of our products. Once goods leave our premises and have been received by you or your installer, the company is in no way liable or held responsible for any loss or damages.  If we do not receive any notice of an issue within 1 working day of receiving the products , they will then be deemed to have been received complete, and in good condition.

 

Payments Commercial Accounts

Goods will not be despatched to you until you have made payment in full to include payment for the price of the Goods plus any charges for VAT, carriage and insurance and if applicable the standard cost of installation, any additional installation charges agreed on following survey are due on completion of the installation. The Account holder will not be entitled to withhold payment of any invoice by reason of any right or set off or any claim or dispute with the Company, whether relating to the quality or performance of the Goods or otherwise.

 

Deliveries

Delay in delivery of goods is beyond our control, delivery of goods is dependent on a supply chain: Distribution, carriers/logistics etc. Delivery schedules cannot be guaranteed, dates for delivery are approximate only. Customers are advised not to commit to an installation schedule, service schedule or appointment with a third party until the Goods have been received and checked for damage and or discrepancies. We shall not be liable for any costs or other losses incurred by you, your agents or any other third party due to an installation schedule, service, booking, or any other appointment committed to by you prior to the Goods being received and checked. We shall be entitled to make partial deliveries or deliveries by instalments. Each instalment shall be a separate agreement to which all the provisions of these conditions shall apply.

 

Receipt of Goods

Signature of any note by you or your agent, employee or representative shall be conclusive proof of delivery. Risk of loss or damage to the Goods passes to you at the time of delivery including Goods which you have asked us to leave unattended at your requested delivery address.

 

Goods

In the case where a product is deemed unacceptable due to a natural occurrence these are issues that are beyond our control and we cannot be held responsible.  Issues such as how the natural environment may impact the colour/finish to an installed product or in the case of marble where the nature of the product can have varying colours /veining/spotting. Customers are advised to check all goods with their installer before such items are fitted. Replacement costs are the responsibility of the customer.

 

Liability

We shall have no liability whatsoever for any failure to perform, or any delay in the performance of any of our obligations under the Contract arising wholly or in part by reason of any factor beyond our direct control.

The appearance of our products in comparison with images of them we publish on our website, in our printed literature or how the natural environment may affect the installation may vary for reasons beyond our control and for which we cannot accept responsibility. 

We will take all reasonable care to ensure that all details, descriptions and prices of goods appearing on the website or our printed literature are correct at the time when the relevant information was entered onto the system. Although we endeavour to keep information shown on the website or in our printed literature as up-to-date as reasonably possible, the information appearing at any particular time may not always reflect the position exactly when you place an order.

 

Order cancellation

We may decline to accept an order from you for any reason. 

We reserve the right to make adjustments to the price payable in the event of any increase in supplier’s prices, VAT or other taxes/duties and/or to an error or omission the price published on our website or printed literature for the Goods (irrespective of whether your order has been acknowledged by email or you have made payment). In the event that any adjustment to the price is made by us, we will give you the opportunity to cancel the order and will return any money already paid by you if you opt to cancel because of an adjustment made by us to the price.

Cancellation of your order will only be accepted if it is deemed that the goods are wholly not suitable and an alternative product cannot be agreed upon. If your goods have already been ordered awaiting delivery a restocking charge will be applied. Other mitigating circumstances will be considered.  Goods will need to be returned in their original packaging and in perfect condition Items received by the company in imperfect condition will not be accepted as returns and will not be eligible for refund, these goods should be collected by you at your own cost.  

To exercise the right to cancel, you must inform us of your decision to cancel this contract by a clear statement (e.g. a letter sent by post or email). Notifications by email must be sent to info@phillipsfireplaces.com. Notifications by post must be sent to: Robert Phillips Fireplaces, 3C Whitemountain Road Lisburn, BT28 3QY. We advise you to include your order number in your notification to avoid delay. Notifications by post will only be effective following receipt by the company. On receipt of your written cancellation notice, the request will be considered and if agreed a refund less any restocking charges via the payment method used within 14 days.

 

Returns and Refunds

The right to return goods set out above does not apply to goods supplied to your specific specification, made to order, personalised or special order items, or Goods which become mixed inseparably with other items after delivery.

You are entitled to withdraw from this contract within 7 days for a full credit or refund. The goods must be unopened and 'as new' in their original box and packaging including all manuals and accessories.  

When we receive the goods, we will inspect them to ensure all manuals, accessories and other components are within the returned package and that the goods and packaging are in the condition that we sent them to you. If we receive an item that either is not in the condition we sent it or has missing components we shall charge you a further fee to cover the cost of these items.

A restocking fee ( 30%) upon return of the goods will be applied, this restocking fee will be passed on to the customer. It is also the responsibility of the customer to ensure that the goods are returned to us via a courier service the cost of which is to be paid by the customer.

 

Warranty

All warranty information is housed inside the appliance. It is the responsibility of the customer to ensure that once the appliance has been fitted to  read the user guidance &  register warranty. Due to the nature of operational  variants of an open fire by the end user, open fire parts are not covered  this also includes cast iron fascia and fireback’s. It is a legal requirement that all gas appliances have a full service history. Should you have an issue with your gas appliance you must contact the gas safe engineer who provided the certificate as first point of contact in order to report the issue. If at some point after purchase the product develops a problem that is not covered by warranty  or where the manufacturer/distributor does not see fit, then the buyer is responsible for organising their own installer / engineer to carry out any remedial work at a cost to them.  The company cannot be held responsible for the final decision made by the manufacturer/distributor or for any additional costs that may occur In the event that the manufacturer/distributor is not willing to cover the costs of: replacement of goods/ transportation/installation costs  free of charge. Please ensure that the goods ordered  are specified to meet the intended purpose.
